General terms and conditions of sale

Notice to users: Please read carefully the terms of our license agreement. By using all or part of the software you agree to all the terms and conditions of this agreement.

 

BY PURCHASING OR USING THE SOFTWARE, YOU AGREE TO BE BOUND BY THE TERMS OF THIS GCV. IF YOU DO NOT AGREE TO THE TERMS OF THIS AGREEMENT, PLEASE DO NOT INSTALL OR USE THE SOFTWARE AND DELETE THE SOFTWARE AND ALL RELATED FILES FROM YOUR DEVICE. THIS GCV IS A LEGAL AGREEMENT BETWEEN YOU (HEREINAFTER - THE USER) AND GGC (HEREINAFTER - THE APPLICATION PROVIDER/GGC) FOR THE USE OF THE SOFTWARE. BY DOWNLOADING, INSTALLING OR USING THE SOFTWARE, YOU AGREE TO BE BOUND BY THE TERMS OF THIS GCV. IF YOU DO NOT AGREE TO THE TERMS OF THIS GCV, YOU MAY NOT DOWNLOAD, INSTALL OR USE THE SOFTWARE.

BY AGREEING TO THIS GCV, YOU AGREE TO INSTALL THE SOFTWARE ONLY ON A DEVICE OR DEVICES OWNED BY YOU, TO USE IT ONLY IN CONNECTION WITH AN ACCOUNT, APPLICATION OR PROGRAM THAT YOU ARE LEGALLY ENTITLED TO ACCESS. YOU ALSO AGREE TO NOTIFY ANY PERSON USING A DEVICE ON WHICH THE SOFTWARE IS INSTALLED AND ANY OTHER PERSON WITH A RIGHT TO ACCESS A MONITORED ACCOUNT OF THE PRESENCE OF THE SOFTWARE. FAILURE TO COMPLY WITH THESE TERMS MAY BE A VIOLATION OF APPLICABLE LAW. YOU UNDERSTAND AND AGREE THAT YOU ARE RESPONSIBLE FOR ALL LEGAL COSTS INCURRED BY THE APPLICATION PROVIDER AND/OR ANY PERSON USING A DEVICE WITH THE SOFTWARE INSTALLED RESULTING FROM YOUR IMPROPER OR ILLEGAL USE OF THE SOFTWARE.

  1. The user agrees to use the software responsibly and to comply with all laws applicable generally to the use of the software and specifically in the jurisdiction where it is activated and used. By checking the box "I have read and accepted the terms and conditions of Global GSM Control*" when ordering, you confirm that you have read, understood and agreed to the terms and conditions and " LEGAL DISCLAIMER "By doing so, you confirm that you will not violate the privacy law and therefore you will not listen to the conversations of a third party made with his/her mobile phone without his/her written and obtained consent. In this way you also confirm that you will not violate the law on privacy and therefore you will not listen to the conversations of a third party made with his cell phone without his written consent and obtained without compulsion.
  2. Obligations of the user
    1. By ordering a Product, you acknowledge and agree that you are over 18 years of age.
    2. When installing the Software on a device, you acknowledge and agree that you (i) are a parent of your minor child (ii) are an employer, owner of the devices operated by employees (iii) own the device in question or have informed the owner of the device and obtained his or her written consent
  3. Important points
    1. The Site and the GGC Software must be used only in the following cases:
      (a) for the purpose of parental control over minor children
      (b) by employers to control devices owned and operated by their employees who must be informed and willing
      (c) by the user on his own equipment of which he is the sole user
    2. By providing your payment information when ordering the Software, you are informed that GGC does not collect this information, it is the Payment Provider who receives the payment information;
    3. You will not be able to use the Site or the Service if you violate any laws to which you are subject. Notwithstanding the foregoing, GGC is not responsible for the use of the Software.
    4. You agree to read the Compatibility page, and to check the configuration of your target device in accordance with the Compatibility page before ordering from the site.
    5. You understand that physical access to the device is required to install the Software.
    6. You agree that GGC is in no way responsible for the installation of the Software on the target device.
    7. You will properly apply all instructions and documentation provided to you by GGC
    8. You do not authorize any third party to access your account or to use the Software. In the event that access to your account has been deliberately granted to a third party, or by mistake, or in any way without your consent, you acknowledge that GGC therefore assumes no liability.
    9. You install the Software on your owned devices or any other device only with the express consent of the owner.
    10. We reserve the right to modify, terminate or refuse the Service to any person for any reason without notice at any time.
    11. We reserve the right to change these terms and conditions at any time.
  4. International use. Although the Website and Software may be accessible worldwide, we make no representation that the Software or related materials are appropriate or available for use in your location, and the Software may not be accessible from territories where the content is prohibited by local law. Those who choose to access the Software from such territories do so on their own initiative and are solely responsible for compliance with local laws, if and to the extent local laws are applicable. Any offer and/or information made in connection with the Software is void where prohibited.
  5. LEGAL DISCLAIMER It is the responsibility of the user of Global GSM Control software to check and comply with all applicable laws in his country regarding the use of Global GSM Control software. If you are in doubt, please inform yourself or consult a lawyer before using Global GSM Control software. By downloading and installing it, you declare that the Global GSM Control software will be used only in a lawful and legal way. Accessing other people's SMS messages or any activities on their phones by installing the Global GSM Control software without their knowledge is totally illegal. Global GSM Control does not assume any responsibility for your behavior and is not liable for any misuse, illegal or damage caused by our software. It is the responsibility of the user of our software to obey all laws of their country. By purchasing and downloading Global GSM Control software, you agree to all the above
  6. The user understands that the data on the server is saved for the user to dispose of and download to his own system, and that this should be done regularly and at least every 60 days. If the data is not downloaded by the user within this period of time, Global GSM Control reserves the right to permanently delete it.
  7. Intellectual property rights The software commercialized by GGC is protected by copyright, without limitation by the provisions of international treaties and the laws applicable in the country in which the software is used. You may not copy the software. You can however transfer the license from one phone to another with the obligation to deactivate it first on the first phone where it was installed. You agree not to modify, adapt or translate the software. This agreement does not give you any intellectual property rights to the software
  8. Reimbursement You have, in accordance with the law, a withdrawal period of 14 days from the date of your delivery to cancel it, under the conditions provided by the regulations in force, and in accordance with our refund policy (read carefully before your purchase)
  9. GGC version upgrade The upgrade from the Silver to the Black Extreme version is possible remotely for the full price of the new Black Extreme version (3 months or 12 months depending on your choice).
  10. Duration of validity of our licenses All our licenses have a validity period of 1, 3 or 12 months, this validity period starts from the date of purchase and not from the activation. As the validity period approaches, you will receive an email reminding you to renew your license. If you wish to continue using our services, you must renew your license by paying the same amount, to do so, you must contact us. You will not have any manipulation to do on the target phone. 
  11. PaymentPayment transactions made by the Customer by credit card or via a Paypal account are not made on our site, but on the site of the secure payment provider PayPro, to which the Customer is automatically redirected. The Customer's credit card number is neither known nor processed by Global GSM Control, but only by PayPro under the conditions set out on its website: www.payproglobal.com. PayPro is a leading company in the field of internet payments, which guarantees total security in transactions.
  12. Availability of the data consultation site: Global GSM Control does not guarantee that its consultation website will function without interruption of service or without anomalies. Global GSM Control may suspend access to the GGC website without prior notice for maintenance and updating purposes or for security reasons. Global GSM Control cannot be held responsible for the failure of telecommunications or the Internet network.
  13. Data availability The data remains available on the Customer's account for 90 days, after this period the data older than 90 days will be automatically purged by the Global GSM Control system, it is recommended to make a backup every 60 days.
  14. Termination of Services: 
    1. The account can be terminated when the subscription expires.
    2. The Service is offered with the understanding that GGC may terminate an account at any time for any reason, including but not limited to any violation of these TOS.
    3. GGC may stop marketing the Service at any time.
    4. GGC reserves the right to refuse service or terminate the service of any user, including but not limited to a user who attempts to monitor an individual's device, who has not given his consent. In this case, GGC reserves the right to terminate the account and all the Services subscribed by the Customer as of right with immediate effect, without prejudice to all other remedies and rights of Global GSM Control.
  15. Assignment: Global GSM Control reserves the right to transfer this agreement at any time to a third party of its choice, provided that this third party undertakes to comply with all the obligations of Global GSM Control towards these Customers without reducing their rights. 
  16. LEGAL EFFECT
    1. These T&Cs describe certain legal rights. You may have other rights under the laws of your country. These T&Cs do not change your rights under the laws of your country.
    2. In the event that the laws of your country do not permit you to use the entire application of the Software, or only certain features, you hereby acknowledge and agree that this is your responsibility.
